Terms of Service

Note: The legally binding version is the Polish-language Regulamin at /pl/regulamin. This English version is a courtesy translation.

Based on art. 8(1)(1) of the Polish Act of 18 July 2002 on Providing Electronic Services, these terms govern the use of https://pawlukstudio.pl.

§1. Definitions

1. Service Provider — Studio Kreatywne Mateusz Pawluk, NIP 8393015674, Mosty, Poland. Contact: kontakt@pawlukstudio.pl.
2. Site — https://pawlukstudio.pl.
3. User — any individual or entity using the Site.
4. Service — functionality described in §2.

§2. Scope of services (all free)

1. Information content (portfolio, blog, services description).
2. Contact form (footer).
3. Newsletter — after explicit opt-in.
4. AI estimation calculator (/estimate) — generates preliminary estimates via Google Gemini API. Estimates are informational and non-binding.

The Site is not an online store — professional services are subject to separate contracts concluded outside the Site.

§3. Technical requirements

• Internet-connected device
• Modern browser (HTML5/CSS3/JS ES2022/TLS 1.3)
• JavaScript enabled
• Active email (for forms)

§4. Contract conclusion and termination

1. Content access — concluded on entry, terminated on exit.
2. Contact form — concluded on "Send", terminated after delivery.
3. Newsletter — concluded on confirmation, terminated on withdrawal.
4. AI calculator — concluded on "Generate estimate", terminated after result delivered.
5. Operator may discontinue free services with 7-day notice.

§5. User obligations

1. Lawful use, compliance with Terms.
2. No unlawful content (art. 8(3)(2)(b) Polish UoŚUDE).
3. No actions compromising Site security (SQL injection, XSS, DoS).
4. No false data in forms.

Breaches → blocking + reporting to authorities if applicable.

§6. Complaints

1. To: kontakt@pawlukstudio.pl.
2. Include: name/company, contact email, problem description (date, time, screenshot).
3. Resolution: 14 days.

§7. Liability

1. No 100% uptime guarantee (maintenance, third-party outages, force majeure).
2. Indicative pricing/service descriptions are informational — not binding offers (Polish Civil Code).
3. AI-generated estimates are preliminary and non-binding — binding only after written contract.
4. No liability for third-party providers (Vercel, Discord, Google, Sanity).

§8. Personal data

Per Privacy Policy, an integral part of these Terms.

§9. Final provisions

1. Governing law: Polish (UoŚUDE, Civil Code, GDPR).
2. Disputes: court with jurisdiction over Operator's place of business.
3. Terms changes: 7-day notice. Continued use = acceptance.
